These content hubs allow you to search by topic or category or by keyword.

Writers can post articles on the content hubs. The benefit for the writer is that he can mention his company and include his web site address in the article. And that provides in-bound links to his web site, from the content hubs themselves, and from every web site where that article is posted. In-bound links, meaning links from other web sites that link to yours, increase link popularity, which is one of the main criteria used by Google and other search engines to determine web site ranking.

Few spectacles symbolize autumn better than a gang of Canada Geese crossing a cloudy sky in V-formation. Common throughout most of North America, Canada Geese live around ponds, rivers, and lake shores where they feed on aquatic grass, roots, and young sprouts, as well as corn and grain. A strong inward pull called instinct urges these waterfowl into the skies to make this great annual southward migration. But instinct does not determine the route the birds take. Canada Geese migrate in family groups, and they will travel the same route year after year. The young geese learn the route from their parents, and use the same route in subsequent years with their own young.

Canada Geese are more family-oriented than many other species of waterfowl. Adults mate for life, although a widow will often choose another mate. Pairs look for appropriate nesting sites in early spring, just as soon as there is open water for mating, and snow-free sites for nesting. Together, they use grass and plant material to build their nests, lining it with feather down. When the nest is ready, the male, called a gander, will guard the area as his mate lays her eggs. An average clutch is five to seven eggs, but it can be as low as two or as high as twelve. Each egg will take a day of more to lay, and incubation lasts about a month.

Both goose and gander are present when the eggs begin to hatch. Goslings use their sharp egg teeth to peck their way out of their shells, an arduous task that can take a full day or two. These newly hatched babies resemble ducklings, with yellow and gray feathers and dark bills; but within a week they will have changed into awkward-looking, fuzzy gray birds. Once out of their eggs, goslings are able to swim immediately, and will enter the water accompanied by both parents. There they will begin their first task of diving and eating. They must eat continually in order to grow sufficiently for their first flight. Newly-hatched goslings can dive 30-40 feet underwater for nutritious, aquatic plants.

At nine or ten weeks of age, goslings have grown their flight feathers and look like smaller versions of their parents. Canada Geese are easily identifiable with their long black necks and heads and contrasting white cheek and throats. Their back, upper wings, and flank areas are brown capes draped over nearly white breasts and bellies. Short black tails, black legs and black webbed feet are visible when they waddle across an open field. While Canada Geese range in size, they are typically 20-50 inches long, with a 50-68 inch wingspan. The largest varieties are called honkers, while smaller geese, one fourth the size, are called cacklers.

The first two months of a gosling's life its entire goose family is earth-bound. Ganders molt directly after mating, and geese molt shortly after her eggs hatch. Unable to fly, the family abandons the nest on foot to find better feeding areas. Adults will have re-grown their new feathers just in time to give their young their first flying lesson.

Few birds are as vocal as Canada Geese, and some say they encourage each other as they take their challenging journey. If you listen carefully, you can determine the gender of the goose by their vocalizations. Ganders speak in a low-pitched honk, while geese use a high-pitched hink. Goslings have a soft, wheezy call.

The journey is made easier by flying in V-formation. By flying in formation, the flock adds 71% greater flying range than if each bird flew alone. As each goose flaps its wings, it creates uplift for those following behind. The geese take turns in the point position, as tired birds rotate back. If a goose is wounded or falls out of formation for any other reason, two of its flock will stay with it until it dies or is able to fly again. Then they will join another formation or catch up with their flock.

Omega-3 Fatty Acids have been getting a lot of attention lately in the news, the scientific community and doctors offices around the world. But what are they? And why have they become the next big thing in heart health?

While the term fatty seems negative, Omega-3 fatty acids actually provide good fats which help support the health of the cardiovascular system, maintain triglyceride and cholesterol levels and, according to the Food and Drug Administration, possibly reduce the risk of coronary heart disease in men. In addition, they assist in promoting a healthy brain function, controlling mood levels and supporting healthy joints and muscular mobility.

Several studies show that international populations whose diets consist of large amounts of foods high in Omega-3 fatty acids have lesser instances of heart disease and cholesterol problems. The Mediterranean diet in particular relies heavily on many servings of fish, antioxidant-rich fruits and vegetables, and uses very little red meat and saturated fats. This diet has been associated with lower levels of cholesterol and healthy heart function. European doctors are so impressed with the effects of Omega-3 fatty acids that Omega-3-rich foods and supplements are often recommended to patients suffering or recovering from cardiovascular problems.

Fish oil capsules and Omega-3 supplements may not be regularly prescribed by American doctors yet, but many medical sources recognize that people who maintain a healthy, well-balanced diet consisting of many servings of fruit, vegetables and fish such as salmon, trout and mackerel have stronger, healthier hearts and better health overall. Even the American Heart Association recommends that people consume foods rich in Omega-3 such as fatty fish (mackerel, tuna, etc.) at least twice a week.

Unfortunately, mens busy schedules often leave little time to prepare or consume meals high in Omega-3 fatty acids. Add to that the fact that some fish available to consumers does not contain the high levels of Omega-3 due to being farm raised. To insure youre receiving the necessary Omega-3 fatty acids from a pure source, consider adding a daily supplement containing high concentrations of Omega-3.

Look for supplements that contain pharmaceutical-grade ingredients that provide the best ratio of EPA/DHA and are carefully distilled to remove all hazardous PCB, toxins and mercury particles. Twins can be the same (identical-monozygotic) or different (fraternal-dizygotic). Fraternal twins, triplets, or more develop when two or more eggs are fertilized by separate sperm. Fraternal fetuses have separate placentas and amniotic sacs (the bag containing the fluid around a baby).

Identical twins come from a single egg that has been fertilized by one sperm. For unknown reasons, the fertilized egg splits into two or more embryos during the first stage of development. Some identical twins share the same placenta. However, they usually grow within separate amniotic sacs in the uterus. In rare cases, identical twins share one amniotic sac (monoamniotic).

Fraternal multiples:

1. Can be of different sexes and may have different blood types.

2. They may look very different from one another, with different-coloured hair and eyes. They may also look alike, as siblings often do.

3. Tend to run in families.

4. They are more common in older mothers, African races and when there is a family history of twins. They are least common in Asian families. If you have already carried fraternal twins, you have double the usual risk of having twins. A history on your partner's side of the family does not increase your risk of multiple pregnancy.

Identical twins

1. Are always the same sex and blood type.

2. They do not necessarily look exactly alike. One may be right-handed while the other is left-handed.

3. They develop at random. They are not related to maternal age, race, or family history of twins.

4. Multiples that are conceived with infertility treatment are usually fraternal, rather than identical.

What are the causes of multiple pregnancy?

1. With increasing maternal age the chance of twins increases. To put it in perspective, your chance of giving birth to twins if you are less than 25 years of age is less than half of what it would be after the age of 35.

2. You are more likely to conceive twins in the first few menstrual cycles after stopping birth control pills.

3. Infertility treatment. Fertility drugs stimulate your ovaries to release multiple eggs, which can be fertilized at once. This may result in a multiple pregnancy. You are, therefore, more likely to have a multiple pregnancy if you use fertility drugs or assisted reproductive technology (ART - In Vitro Fertilization IVF).

4. ART is the transfer of embryos directly into the uterus. In the early days, when success rates were extremely low, several embryos were transferred in the hope of achieving a pregnancy. Nowadays, 25% to 30% of pregnancies from ART are twins; 5% are triplets and less than 1% are quadruplets or more. As techniques have improved, success rates from IVF/embryo transfer have increased and reasonable success rates are being achieved with single embryo transfer and this reduces the incidence of multiple pregnancies.

What is the prevalence of multiple pregnancy?

The natural incidence of twins is 1 in 80 pregnancies and for triplets 1 in 8000 pregnancies. The incidence is rising as a result of IVF and a tendency for women to deliver later in their reproductive years. Naturally occurring quadruplet births occur in 1 per 600,000 births. The UK would, therefore, expect one set of naturally occurring quadruplets each year. There are estimated to be approximately 125 million human twins and triplets in the world, and just 10 million identical twins.

One in two pregnancies with same sex babies are monozygous (identical twins). The rate of identical twins remains at about 1 in 333 pregnancies across the globe.

Calculating the Correct Distance

In setting up the environment for your plasma TV, a primary consideration is to determine the screen size to match the floor plan or available space where the plasma will be displayed.

Plasma monitors are measured diagonally across the screen, just like any other television set. You can typically choose from the following sizes: 32", 40", 42", 46", 50", 61", or 63". Bigger is not always better, and a certain distance must be maintained between the plasma TV and the viewing area for optimal viewing experience. Sitting too far away diminishes the overall impact. Sitting too close, however, could also present its own problems - as when you start seeing the screen's "structure"; i.e., the dots or pixels that make up the plasma display.

In determining the appropriate TV size for you, you should also consider the space required to install the unit itself. When recessing a plasma display unit, allow at least 3 inches of open space at the top of the unit and adequate ventilation space of at least 2 inches behind it as well. Remember, too, that most plasma displays do not have built-in speakers, so you'll need to allow space enough to attach speakers.

What You Can Watch on Your Plasma TV

You can choose between HDTV (High Definition TV) and EDTV (Enhanced Definition TV) for your choice of plasma display. Which type you prefer depends on the kind of material you intend to watch on the plasma.

EDTV is the perfect entry point into digital television, with a widescreen 16:9 aspect ratio and an image resolution that is 200% better than today's analog televisions. On the other hand, HDTV has up to four times the resolution and colors compared to EDTV, offering the ultimate visual and sound experience.

At present, only a limited number of programs are broadcast in true high-definition format (all major networks broadcast HD counterparts to their regular analog-signal broadcasts). In fact, if you plan to use a plasma HDTV for regular TV programming, you may be surprised to find that regular TV programming may even appear slightly worse, as the big screen exaggerates the flaws in standard TV programs. Why bother with a High Definition TV at all, you may ask? Because HDTV, paired with a true High-Definition or high-quality source, can produce truly stunning images. With a progressive-scan DVD player paired with, say, any of the recently released HD-DVD or forthcoming Blu-ray DVD titles (encoded in true HD format), your plasma HDTV can come to spectacular life and bring out unrivaled image quality. And as more TV programming becomes available in High-Definition format with the looming of the FCC deadline for switching to all-digital broadcasting, plasma HDTV sets will have more TV content to show. One thing's for sure: Your HDTV won't be obsolete anytime in the next few years.

Specifications When comparing plasma TV sets, it's important to know what to look for to make sense of the specifications you're presented with. Below is a quick rundown on the necessary specs that you need to weigh before making that all-important purchase decision.

Resolution: Resolution is a determining factor in selecting a plasma TV. Do you want HDTV or EDTV? HDTV, with a resolution of at least 1024 x 720, is the ultimate visual and sound experience, but what is available for viewing on HD is currently restricted to a few HD channels on cable, as well as the newly emerging - and necessarily few - DVD titles from the HD-DVD and Blu-ray DVD formats. On the other hand, most of the currently available DVDs actually play better when viewed on EDTV, because the image resolution of a widescreen DVD (nominally 740 x 480) more closely matches the actual resolution (852 x 480) of the EDTV plasma display. Inputs: A plasma television should work with any existing video component with standard A/V, S-Video, or Component Video outputs. In addition, most plasma TVs have DVI or HDMI connections for use with high-definition sources. Some plasma TVs also have VGA input connections that allow them to be used as monitors for a PC. At the minimum, look for the following specifications on a plasma connection: DVI-I or DVI-D, Component, RCA or Composite, and S-Video. Take into consideration your current component set-up - such as your satellite system, cable box, DVD player, and external stereo components - and see what kind of inputs or connectors they use.

Tuner: Check your plasma to see if it is HD-ready or HD-integrated. An HD-ready plasma TV is essentially a monitor that needs an external tuner source before it can function as a TV. An HD-integrated panel has a tuner built into the set and is ready for use. If you receive your HDTV programming via cable or satellite instead of over-the-air, you may not need a tuner at all, as you will be using the set-top boxes provided by your cable/satellite service to receive HDTV programming. Check with your cable or satellite providers for more details. Some cable/satellite companies do away with set-top boxes and provide their subscribers with cable cards instead. Check with your cable/satellite provider if they provide cable cards and the cable-card type that they offer, and then check the specification on the plasma for cable card slots.

Contrast Ratio: Contrast ratio is the measurement that determines the variation between the whitest and darkest parts of the image. This is an important specification, since plasma TVs with a low contrast ratio will make dark images look muddy and gray while making light images look washed out. A good measure of contrast ratio is 1,000:1 or higher. Anything less than 1,000:1 - especially on a set that is 42" or larger - may not provide optimal viewing experience.

Brightness: Without sufficient brightness, your image will look muddy and soft - even in a dark room. Viewing distance, screen size, and ambient room light will also affect the need for more brightness capability. A brightness rating listed at 550 cd/m2 or higher is good, but don't get bogged down with the technical number listed. Instead, make sure that the screen is bright enough for your needs as you conduct your own visual inspection.

Panel Life: Look for a minimum of 60,000 hours of panel life in your plasma specifications. This is the rating on how long it would take before your panel has half the brightness compared to when it was new. A 60,000-hour spec translates to approximately 20 years of viewing at 8 hours per day. (This approximation may vary, depending on the source and type of content, settings, environment, and use of your plasma TV.)

Anti-burn-in/Pixel Shift: Burn-in refers to the remnants burned on to the screen after a static image has been left on the plasma for a long period of time. To minimize or prevent burn-in, determine if the plasma panel utilizes burn-in protection, such as power management settings, full-time picture or pixel shift (both vertical and horizontal) technologies, or automatic screensaver functions.

Speakers: If you plan to use an external surround sound system, you won't need audio speakers, but most plasma TV sets include speakers that rated anywhere from 7-12 Watts Pre-amp - which is much better than that of conventional TVs and sufficient for most viewing. Check your plasma's specifications to see if it comes with speakers and if the speakers are removable.

Universal Remote: A universal remote can take the place of having one remote, so that it controls all the various components of your TV system, such as the DVD player, audio, cable/satellite etc. If you plan on buying a universal remote, check to see if it's supported by the plasma set of your choice to make sure the plasma accepts universal remote devices.

Power Consumption: Power consumption for plasmas range from 240 watts to over 500 watts, If you're concerned with how much energy a plasma set may use, check its specifications to determine power consumption. Units tend to have higher wattage requirements as the screen increases. A good rule of thumb is to compare similar-sized units together; units with higher wattages tend to use inferior components as a rule.

The Green Packers will try in week four to show that the game in week three was not a fluke. Granted, Brett Farve played a game that would rival any he has played to day. He dominated in that game with three touchdowns and no interceptions. That was a game that snapped a twelve game run that had Favre throwing an interception in each game. Many had thought that this was a sign that Favre was past his prime, almost on cue he dominated the game and proved the critics wrong.

The Packers will have a challenge in the form of the Philadelphia Eagles and the powerful offense that they have. The Eagles team tore apart the 49er's and showed that the 2-1 record that they have was one that was earned for good reason.

The Packers want to change the 1-2 record and get back to .500. This is a goal that they have and they hope that they can make a difference as they seem to be coming together as a team. The key is that the team has to pick up more of the load and help Favre not be the one carrying the full payload like he did in week three.

Favre savored the week three victory, but even he has admitted that more needs to be done on Monday night if they are to leave with a two in the win column. This is his hope, and it may be something that he will have to face head on with this young core that is just starting to show real signs of melding into the team that all cheese heads hope they will be.

This is just the beginning of the season, but these games may count the most as the team sees the season winding down later at the end of the year. Fuel prices are skyrocketing out of control and everyone is looking for a way to put some of that money back into their pockets. No matter what your economic structure may be, people the world over are concerned about the soaring fuel prices. Do you realize within about ten years we could very well be paying around $10.00 per gallon.

Unbelievable! Just think about it, if you are a two or three car family you are in all probability paying more money to drive your cars then you are spending on groceries to feed your family in a month. In most cases it costs more money to drive your car then it costs to heat your house, and guess what folks we all continue to drive, most of us have no choice.

A lot of us have discontinued driving that vehicle that we love so much just because it is no longer economical for us. There have been so many different products on the market professing that they can save you money on fuel. Some are good, some are bad a lot of them are so expensive that why even bother? How do we know they really work?

Now its a given that almost everyone would like to save money on gas. There are a lot of different gadgets and gizmos out there, that have to be installed, and just are not worth the time and effort to even put into your automobile, bottom line they simply dont work. And what about all those additives that you have to measure just the right amount another painstaking method, also we have found most of these products to be extremely costly, and a very small percentage of them actually work.

While picking a product that is effect to use in your gas tank try to stay away from anything that may contains naphthalene which by the way is moth balls and is very harmful to your engine and the environment, also in our studies weve learnt that detergents may clean your engine but they are ineffective on saving on mileage.

Diversity In Chicago Schools

On the last day of the 2006-2007 Supreme Court, Chief Justice John Roberts announced a decision that will inevitably stir up diversity issues within schools across the nation, and the Chicago Schools. It will most certainly change the way most school systems, including those within the Chicago Schools, run their magnet programs. And it will affect how they decide which students to steer towards, and to accept into, each program.

The decision decried racial balancing in schools where race is used for magnet programs. Many of the magnets within the Chicago Schools use race as a factor in accepting students into their programs. There is one group of magnets in the Chicago Schools that selects students based completely on racially weighted lotteries. The students applications are sorted according to race, and then drawn in lotteries. This is meant to achieve racial diversity. Acceptance into other magnet programs is based on grades, test scores, academic achievement, and extracurricular involvement. Race is used as a minimal determining factor.

Some administrators in the Chicago Schools fear that this threatens the legacy of Brown v. Board of Education; the decision in which segregation based on color was denounced.

Patrick Rock, the attorney for Chicago Schools, stated that the decision will only affect Chicago Schools if and when a federal justice agrees to release them from a desegregation consent decree which dates all the way back to 1980. He stated that at some point in the future the Chicago Schools may ask to have the decree dissolved but states the question is when. Rock also said that the Supreme Court ruling only affects how the Chicago Schools run their programs after the decree is dissolved. That may not be until the fall of 2008. This is when the application process will begin for the 2009 school year. In the meantime Chicago Schools magnets will continue to use the same criteria for admittance into the programs.

Administrators say that Chicago Schools use race as a determining factor to keep schools racially diverse. Not as a means to segregation. The Supreme Court ruling does not disallow the Chicago Schools from using race. It simply states that a valid and compelling reason must be given for doing so. In the Chicago Schools these reasons often include ensuring racial diversity in the many areas where it doesnt exist.

Rock doesnt feel that the Chicago Schools will eliminate magnet programs in order to avoid litigation, however, there are those on the Supreme Court who feel that many school systems nationwide may begin to dissolve their magnet programs to avoid litigation and its ensuing costs. The Chicago Schools may choose to use race as a way to determine where to build schools to ensure this diversity, how to fund schools in certain areas, and which programs to steer students towards- based more on their talents and achievements and not solely to fill a certain percentage of racial mix.

Solvents are added to oil paints for temporary change, they are designed to work in a way such that they evaporate consistently and completely as the oil paint dries. (Technically, the more correct term is diluents, as not all are solvents, but it's not the term very commonly used.) Solvents are also used to soften resins, making mediums, cleaning up, and also for cleaning brushes. It is very essential to use solvents in a well-ventilated room and you need to remember that they are flammable (catch fire easily).

Turpentine is the traditional solvent used in the oil painting. It's actually based on tree resin and has a very fast evaporation rate, releasing harmful vapors. It could also be absorbed through healthy skin. Try using only artist quality turpentine as the industrial variety you will find in hardware stores probably contains impurities; it needs to be colorless, like water. It is also known as spirit of turpentine, oil of turpentine, genuine turpentine, English turpentine, distilled turpentine; double rectified turpentine, or even simply turps.

Mineral spirits is based on pure petroleum and has a moderate evaporation rate, releasing harmful vapors. It is not absorbed through healthy skin like turpentine. Mineral spirits is less expensive than turpentine. Mineral spirits is a stronger solvent than odorless mineral spirits, also called as white spirits.

Odorless mineral spirits is based on petroleum and has a reasonable evaporation rate. It is again not absorbed through healthy skin. It's quite expensive than normal mineral spirits as it has had some of the harmful perfumed solvents removed. Good brands include Turpenoid, Thin-ex, and Gamsol.

Tip: Test the quality of a solvent by putting a little on a drop of paper and to let it evaporate. If it doesn't leave any resident, stain, or smell, it needs to be good enough for oil painting.

Resins are used to increase the shine of oil paint, reduce the color, reduce drying time of a medium, and add body to drying oils. The most used one is a natural resin known as Damar that should be mixed with turpentine as it would not thoroughly dissolve when mixed with mineral spirits. Damar could also be used as a varnish.

Whenever I read new statistics, I always refer back to my favorite expert, Dr. Joseph Hibbeln, National Institutes of Health, one of the world's leading authorities on Omega 3. I read the other day we now have 60,000 pre-packaged food items available in super Wal-Marts, Targets, grocery stores, and back in the 50's we had a mere 2,000 items. And I was reminded of this excerpt from Dr. Hibbeln's radio broadcast:

"I have data from the USDA of how much of every food was consumed from 1909 to the year 2000. We know what was available for purchase in the US diet. Seed oils and these Omega 6's were a very small tenth of a percent or hundredth of a percent of the calories in the US diet in evolution and at the turn of the century. Now they are 20% percent of all calories in the US diet. Where do you find it? Every time you pick up a pre-manufactured food and it says vegetable oil. Soybean oil is called the lubricant of the food industry and it literally is."

It's just so easy to go to fast food restaurants, out to dinner to your favorite restaurant, pick up something pre-packaged for dinner on the way home from work. If you're working 40 hours plus like most of us, have children and maybe a husband or significant other to feed, by the time you get home everyone's hungry and you don't have time or the desire to cook.

Unknowingly, unsuspectingly, never believing all this seed oil could harm us in more ways than calories, we consumed more and more of it in our foods until we've reached a health epidemic in the US. With Harvard reporting 3 out of 4 Americans have either chronic pain, a disease or depression, and with the seed oil link to inflammation established, it seems pretty conclusive, we are drowning in an over-abundance of seed oil. By the way, the statistics just two years ago was 2 out of 3 Americans. Now that's pretty scary.

Research has come a long way since that article to state what we know conclusively today - we need Omega 3 EPA DHA on a daily basis, in sufficient quantities, from a molecularly distilled source, to change the balance of fatty acids in our bodies. All we have to do is balance out the over-abundance from seed oil to a balanced ratio from Omega 3 fatty fish. For me, it felt like turning a hose on the fire within smoldering for a while until finally it was extinguished.

A few years ago, when Dr. Perricone's book first came out, The Anti-Inflammatory Diet, advocating salmon at least once a day, twice if possible, I found some relief from painful inflammation. The thought of eating two servings a day was more than I could bear and turned to the shelves for a supplement. A Summary of Virginia Medical Malpractice Laws

In many respects, Virginia has been more conservative about modifying the common law than its sister states. To the extent modifications have been approved, many restrict rather than expand the rights of the victims of medical negligence. For example, Virginia has adopted three major modifications of medical malpractice law: a damage cap, screening of proposed lawsuits by a medical review panel, and a state fund to compensate victims of birth-related neurological injuries. Much of the legislation specific to medical malpractice can be found in the Medical Malpractice Act, Va. Code Ann. 8.01-581.1 to 8.01-581.20.

Statutes of Limitations

All medical malpractice actions for injury (as opposed to death) must be brought within two years from the date the cause of action accrued. Va. Code Ann. 8.01-243(A). In 8.01-230, a cause of action accrues at the time of injury: the cause of action shall be deemed to accrue and the prescribed limitation period shall begin to run from the date the injury is sustained in the case of injury to the person... and not when the resulting damage is discovered.

This two-year limitation has long been applicable, and strictly enforced, in Virginia. Virginia is one of the minority states that use the date-of-the-act rule, which means that the plaintiff must file suit within two years of the date of the injury regardless of how obscure or undiscoverable the injury might have been. Exceptions to the two-year rule are (i) cases involving minors or mentally incompetent people who are in law regarded as unable to know their legal rights and (ii) cases where the injury was fraudulently concealed from the person.

The Virginia Supreme Court rejected the judicial adoption of a discovery rule, Nunnally v. Artis, 254 Va. 247, 492 S.E.2d 126, (1997), but held that continuing treatment for the same conditions tolls the statute of limitations until treatment ends. Grubbs v. Rawls, 235 Va. 607, 369 S.E.2d 683 (1988). The court defined continuous treatment as not mere continuity of a general physician-patient relationship; we mean diagnosis and treatment for the same relating illness or injuries, continuing after the alleged act of malpractice. The court acknowledged, however, the rule would not apply to a single, isolated act of malpractice. Farley v. Goode, 219 Va. 969, 252 S.E.2d 594 (1979). In other words, when an act of malpractice occurred and that physician continued to see the patient over a course of years for an unrelated condition, the rule would not apply.

In foreign object cases (surgical sponges, needles, etc.) and cases of fraud or concealment (i.e., alteration of medical records) the statute is extended to one year from the date the object or injury is discovered or reasonably should have been discovered. However, this extension is subject to a ten-year limit from the time the cause of action accrued. Va. Code Ann. 8.01-243(C).

In cases in which the health care providers negligence caused the patients death (Wrongful Death Claims), suit must be filed within two years of death. Va. Code Ann. 8.01-244(B).

If a person entitled to bring a personal action dies with no such action pending before the expiration of [the two-year] limitation period... then an action may be commenced by the decedents personal representative before the expiration of the limitation period... or within one year after his qualification as personal representative, whichever occurs later.

However, 8.01-229(B)(6) states that:

[i]f there is an interval of more than two years between the death of any person in whose favor . . . a cause of action has accrued or shall subsequently accrue and the qualification of such persons personal representative, such personal representative shall, for the purposes of [the statute], be deemed to have qualified on the last day of such two-year period.

A parent's action for medical expenses caused by injury to a minor must be brought within five years. Va. Code Ann. 8.01-243(B). A minor's medical malpractice action for injury or death must be commenced within two years from the date of the last act of negligence, unless the child is less than eight years of age, in which case the action must be brought by the child's tenth birthday. Va. Code Ann. 8.01-243.1. The Virginia Supreme Court has upheld the constitutionality of this statute. Willis v. Mullett, 263 Va. 653, 561 S.E.2d 705 (2002). Incapacity (typically a substantial mental or physical handicap) also tolls the running of the statute of limitations during the period of incapacity. Va. Code Ann. 8.01-229(A).

Contributory or Comparative Negligence

Virginia recognizes the doctrine of contributory negligence in medical malpractice cases. A plaintiff's contributory negligence may bar her recovery entirely, but the patients negligence must be concurrent with the defendant's negligence. Sawyer v. Comerci, 264 Va. 68, 563 S.E.2d 748 (2002); Ponirakis v. Choi, 262 Va. 119, 546 S.E.2d 707 (2001).

Joint and Several Liability

Virginia imposes joint and several liability on joint tortfeasors. Va. Code Ann. 8.01-443. Thus, any joint tortfeasor against whom judgment is entered is liable to the plaintiff for the entire judgment, regardless of the tortfeasor's degree or percentage of fault. For example, in a hospital setting, if the attending doctor and nurse are both negligent, then each one can be held responsible for the patients entire injury even if part of that injury was caused by the others negligence.

Vicarious Liability

Under the doctrine of respondeat superior, hospitals in Virginia are vicariously liable for the negligence of their employees but not that of independent contractors. McDonald v. Hampton Training School for Nurses, 254 Va. 79, 486 S.E.2d 299 (1997). Whether a physician should be considered an employee is a question of fact not to be determined by whether the hospital calls him one, but by the factors of selection and engagement, payment of compensation, power of dismissal, and (most importantly) power to control the physician's work. A physician's exercise of professional judgment in the performance of professional duties is a factor, but not the only factor, in deciding whether the hospital has the power to control his work. There is also authority for holding a hospital liable for the act of a physician on the theory of negligent credentialing. Stottlemyer v. Ghramm, 2001 Va. Cir. LEXIS 501 (Va. Cir. Ct. July 13, 2001)(affirmed at 2004 Va. LEXIS 99 (2004). In other wor!

ds, a hospital can be held legally responsible for granting hospital admission and treatment privileges to an unqualified physician.

Expert Testimony

Except for rare cases within the common knowledge and experience of lay jurors, expert testimony is necessary to establish the standard of care, a deviation from the standard, and the proximate cause of injury. Perdieu v. Blackstone Family Practice Center, Inc., 264 Va. 408, 568 S.E.2d 703 (2002). To testify as an expert on the standard of care a witness must demonstrate expert knowledge of the standards of the defendant's specialty and have had an active clinical practice in either the defendant's specialty, or a related field of medicine, within one year of the date of the alleged act or omission. Va. Code Ann. 8.01-581.20.

Damage Caps

Virginia imposes a cap (limit) on damages of all kinds in medical malpractice cases. For claims arising out of acts or omissions prior to August 1, 1999, the damage cap is $1 million. For acts or omissions on or after August 1, 1999, and before July 1, 2000, the cap is $1.5 million. The cap is increasing by $50,000 every July 1. Two final increases of $75,000 beginning in 2007 will bring the damage cap to $2 million for acts or omissions on or after July 1, 2008. Va. Code Ann. 8.01-581.15. The Virginia Supreme Court has twice considered this legislation and held that it does not violate the U.S. or Virginia constitutions. Pulliam v. Coastal Emergency Services, Inc., 257 Va. 1, 509 S.E.2d 307 (1999); Etheridge v. Medical Center Hospitals, 237 Va. 87, 376 S.E.2d 525 (1989).

A settlement with one defendant reduces the maximum liability of the others, because the cap limits the total amount recoverable for an injury to a patient, regardless of the number of theories or defendants. Fairfax Hospital System v. Nevitt, 249 Va. 591, 457 S.E.2d 10 (1995). This includes punitive damages. Bulala v. Boyd, 239 Va. 218, 389 S.E.2d 670 (1990). In cases arising prior to March 28, 1994, when the definition of "health care provider" was broadened in Va. Code Ann. 8.01-581.1, a physician's professional corporation may be subject to uncapped liability. Schwartz v. Brownlee, 253 Va. 159, 482 S.E.2d 827 (1997).

Virginia limits punitive damages to $350,000. Va. Code Ann. 8.01-38.1. This cap has also been determined to be constitutional by the Fourth Circuit Court of Appeals. Wackenhut Applied Technologies Center, Inc. v. Sygnetron Protection Systems, Inc., 979 F.2d 980 (4th Cir. 1992).

Statutory Cap on Attorneys' Fees

There is no Virginia statute setting a limit on attorneys' fees in medical malpractice actions.

Periodic Payments

Periodic payments or structured settlements are allowed, but not required in Virginia. A settlement agreement on behalf of a disabled person, including the situation where the plaintiff is a minor (under the age of 18) involving periodic payments must be reviewed by the court and secured by a bond or insurance. Va. Code Ann. 8.01-424.

Collateral Source Rule

Virginia recognizes the collateral source rule, under which the plaintiffs receipt of collateral payments (health insurance, paid leave of absence from work, etc.) does not reduce his recovery. This protection is statutory for lost income (Va. Code Ann. 8.01-35) but the courts follow the rule for all damages in tort cases. Schickling v. Aspinall, 235 Va. 472, 369 S.E.2d 172 (1988).

Pre-Judgment Interest

In Advanced Marine Enterprises v. PRC, Inc., 256 Va. 106, 501 S.E.2d 148 (1998), which was not a malpractice case, the Virginia Supreme Court reversed an award of pre-judgment interest on the unliquidated part of the damages, stating, "Generally, prejudgment interest is not allowed on unliquidated damages in dispute between the parties." This should apply to most medical malpractice claims. However, the decision also notes that Va. Code Ann. 8.01-382 leaves the date from which interest should run to the sound discretion of the trial court. In Pulliam v. Coastal Emergency Services, Inc., 257 Va. 1, 509 S.E.2d 307 (1999), the court reversed an award of pre-judgment interest because it exceeded the damage cap, but did not comment on whether such interest should have been awarded at all. In cases where pre-judgment interest is proper, the rate is six percent. Va. Code Ann. 6.1-330.54.

Birth Injury Claims

Virginia does not have a general patient compensation fund covering all medical malpractice claims. However, the Birth-Related Neurological Injury Compensation Act (Va. Code Ann. 38.2-5000 to 38.2-5021), covers infants who suffer permanent, disabling damage to the brain or spine caused by oxygen deprivation or mechanical injury during labor, delivery, or resuscitation. This no-fault program is the exclusive remedy for such infants and their parents against participating physicians and hospitals, who must pay an annual assessment. Va. Code Ann. 38.2-5001 and 38.2-5002. A claim filed under this statute proceeds in an adversarial fashion and the Virginia Attorney General represents the Fund in opposing the infants claim.

If the claim is determined to be compensable, the Fund provides for lifetime medical expenses as well as one-half of the Virginia average weekly wage after the child reaches age eighteen. Va. Code Ann. 38.2-5009. Many hospitals and physicians choose not to participate. In cases arising prior to April 1, 2000, a participating physician's professional corporation may be sued even in cases otherwise covered exclusively by the fund. Jan Paul Fruiterman, M.D. & Associates v. Waziri, 259 Va. 540, 525 S.E.2d 552 (2000). Although the legislature promptly closed this loophole by expanding the definition of "participating physician" in Va. Code Ann. 38.2-5001, the Virginia Supreme Court declined to apply the amendment retroactively. Berner v. Mills, 265 Va. 408, 579 S.E.2d 159 (2003).

Immunities

Virginia has waived sovereign immunity in tort cases, subject to significant limitations. No claimant may recover more than $100,000 or the limits of applicable insurance, whichever is greater. In medical negligence cases, the immunity most often comes into consideration when there is a claim against the Medical College of Virginia or the University of Virginia Health System. For example, sovereign immunity has been applied to protect hospital administrators as well as surgical interns and residents at the University of Virginia Hospital. Lawhorne v. Harlan, 214 Va. 405, 200 S.E.2d 569 (1973), overruled on other grounds, First Virginia Bank v. Baker, 225 Va. 72, 301 S.E.2d 8 (1983); Hall v. Roberts, 548 F. Supp. 498 (W.D. Va. 1982). This immunity may extend to other physicians employed by the state, depending on the degree of control exercised over them, Lohr v. Larsen, 246 Va. 81, 431 S.E.2d 642, (1993), but never to independent contractors. Atkinson v. Sachno, 261 Va!

. 278, 541 S.E.2d 902 (2001). Virginia has not waived sovereign immunity for local units of government. Municipalities are immune for negligence in the performance of governmental functions, including the operation of a hospital. Edwards v. Portsmouth, 237 Va. 167, 375 S.E.2d 747 (1989) (dictum).

A charitable entity is not liable to its beneficiaries for the negligent acts of its agents if due care has been exercised in their selection and retention. Mann v. Sentara Hospitals, Inc., 59 Va. Cir. 433, 2002 Va. Cir. LEXIS 363 (2002) (discussing application of the doctrine to a medical faculty foundation). However, charitable immunity has been withdrawn from hospitals, except where a hospital renders exclusively charitable medical services, or where the patient signed an express agreement providing that all medical services would be supplied on a charitable basis. Va. Code Ann. 8.01-38.

Medical Review Panels

The Virginia Medical Malpractice Act provides for a system of medical malpractice review panels to assess the validity of medical malpractice claims. At the request of either party, the Supreme Court of Virginia appoints a panel to review the claim, consisting of two doctors, two lawyers, and a non-voting judge as chairman. Va. Code Ann. 8.01-581.2 and 8.01-581.3. The panel determines whether the evidence supports the conclusion that the health care provider failed to comply with the relevant standard of care and whether that failure proximately caused the injury. Va. Code Ann. 8.01-581.7. The findings of the panel are non-binding and the claimant has the option of filing a lawsuit after the panel has made its ruling. However, any opinion of the medical review panel is admissible as evidence in a subsequent action. Both parties have the right to call panel members, except the chairman, as witnesses. Va. Code Ann. 8.01-581.8.

Arbitration

Arbitration is a process by which potential litigants can resolve their dispute without resorting to the civil court system. In most arbitration cases, the parties agree to arbitrate their dispute after the event occurs and the claim arises. However, parties may also agree in advance of treatment to binding arbitration of any claim, so long as the patient has the option to withdraw from the agreement within 60 days after the termination of treatment. Va. Code Ann. 8.01-581.12.

Search Engine Optimization And The Magic Fairy Dust

There is only one thing that all webmasters agree upon... They all want to be at the top of the search engine results for search terms that will drive traffic and consumers to their website.

The truth is that the search engines are like our childhood game of King Of The Hill. Only one person can be at the top of the hill and the top of the search results. Only ten websites can be on page one of the search results. When a new website moves into the top ten, another must be removed.

For any given search term at any given time, there are only ten web pages on page one of the search results, and there are millions of web pages that did not make page one, who may or may not catch a few stragglers from the search engines.

How Can A Website Break Into The Top Ten?

Search Engine Optimization (SEO) is an industry that has sprung up around the concept of helping their clients improve their rankings in the search engine results.

When you talk to SEO professionals, they generally point to a two-pronged approach to search ranking optimization. A website owner needs to optimize their on-site real estate for the search engines, and they need to build inbound links to their website.

On-Site Search Optimization Challenges

The trick with on-site search optimization is that you must cater to multiple audiences on your website.

* You must provide simple navigation and an attractive interface to the human visitor;

* You must provide good sales copy to your human visitors, for the purpose of converting them from shoppers to buyers;

* You must provide text copy for the search engines to read; and

* You must optimize your content to help the search engines know what topics and keywords they should pay attention, so that they can give their users the right web page for the right search terms.

A web page that draws good search rankings is useless if the web page cannot convert the human visitor to a buyer. Many website owners get caught up in the process of optimizing a web page to get it to the top of the search results, and they forget that the human visitor knows where the Back Button is in his or her browser. Once your visitor has hit the Back Button, they will go to someone else's website and buy from them, instead of you.

Most website owners have the alternate problem. They consistently convert a significant number of visitors to buyers, but they have to rely on various forms of paid advertising to get visitors to their websites, since they do not rank in the search engines.

I recently spoke with an individual who spends ,000 per month on pay-per-click advertising to get targeted traffic to his website. He said he consistently earns back his money, but he was still looking for a better way to get ranked in the search engines, so he joined my client list.

On-Site Search Engine Optimization Basics

According to the search engine companies, there are more than one thousand calculations that determine how well a website will rank in their search engine result pages (SERPs).

The Google engineers are fond of saying that if you build your website for human beings instead of search engines, then your website should rank well in their algorithms. To a certain degree, this is a good strategy.

Think about how magazines are constructed:

The Table Of Contents shows story titles, brief descriptions, and page numbers telling you where you can find a story.

On the story page, the title will be in big, bold font. Sometimes, the magazine will include a brief blurb about the story, in italics or font that is a bit bigger than the story font.

Pictures support the story with captions that further develop the story, by describing the picture.

Major subsections of the story have their own subheadings. And, the primary body of the story is in regular plain text, with only an occasional bolded or italicized word or phrase.

By analyzing the title and other large text on the page, a person who is flipping through the pages of a magazine can quickly assess the story content and make the decision as to whether they want to read the full story.

In the most simplistic way, this is how the search engines analyze a websites' content to decide which web page will best serve their users' needs.

Off-Site Search Engine Marketing (SEM) Basics

Since the inception of Google, and with Yahoo and MSN recently, the number and quality of links pointing to a website play a significant role in determining how well a web page will rank in the search results.

I have heard people suggest that as much as 75% of the value given to a web page in the search results is based solely on the number and quality of links pointing to a web page. I tend to believe a more conservative number (50.1%) will apply.

Inbound Links Are More Important Than Page Content

To prove this point, type "click here" without the quotes into Google, Yahoo and MSN and check the Adobe pages that come up in the search results: #1 in Google, #2 in Yahoo, and #1 in MSN. When you pull up those pages, search the page to find the individual words "click" or "here" in the text of those pages. They are not there. This has happened because millions of people have linked to these Adobe pages with the embedded anchor text, "click here".

Next, let's analyze those specific web pages from the perspective of each of the search engines:

* Google's #1 result - Google PageRank 8. (www.adobe.com/products/acrobat/readstep2.html) Links to this web page: according to Google (31); according to Yahoo (nearly 12 million); according to MSN (6,400).

* Yahoo's #2 result - Google PageRank 10. (www.adobe.com/products/flashplayer) Links to this web page: Google (15,200); Yahoo (700 thousand); MSN (32).

* MSN's #1 result - Google PageRank 8. (www.adobe.com/shockwave/download/download.cgi?P1_Prod_Version=ShockwaveFlash) Links to this web page: Google (0); Yahoo (2.9 million); MSN (778).

On Google's top result, they show 31 inbound links total for that web page. But, Yahoo claims that there are more than 12 million links to this page. That is a huge difference.

On Yahoo's #2 result, MSN gives 32 links, Google gives 15,000 links, and Yahoo claims it has 700 thousand links! That is another huge difference between the link counts from the search engines.

On MSN's #1 result, MSN shows a strong link count, but still nowhere near Yahoo's 2.9 million links. But, how does a web page with zero links in Google get a PageRank 8?

What Do These Numbers Mean?

Google has always said that they will never show us all of the links that we have pointing to our websites, because anything we can see in the public search results, our competitors can see also. So, for me it really is no surprise that we cannot see all of the links that point to Adobe pages, or to the links we have created that point to our clients and ourselves, by querying the search engines.

Also, the sheer numbers of inbound links do not rule the roost. Google's #1 result (PR8) is actually shown in Google, before Yahoo's #2 (PR10) result.

The Proof For Link Building Is In The Search Engine Rankings

Recently, a fellow who works as a SEO "professional" told me that be believed my link building system was a sham.

I showed him that on the top 51 keyword phrases we use to market our original commercial website, we had 11 number one results, 31 top five results, 34 top ten results, 47 top thirty results, and 51 top 100 results within the Google search results. Additionally, it was shown that only three of those results competed with fewer than one million search results according to Google, with the remaining 48 pages competing with one million to 533 million pages.

Ole boy tore up Google trying to track how it was possible for me to have accomplished what I claimed. He finally concluded that since Google would not show HIM how I was able to rank so well in their search engine results, then I must have been lying.

According to Yahoo, we have over 12,000 links from third-party websites. According to our site statistics, we received traffic from more than 16,000 unique web pages during 2006. And Google still swears that we only have 42 inbound links to our website!

Magic Fairy Dust

My nemesis concluded that since HE could not prove through Google how I was successful in getting good search rankings, then I could not have accomplished such results by the methods I claimed.

Okay, I admit it.

I used the exact same method that Adobe used to get to the top of Google's search engine rankings. I have a pocket full of magic fairy dust. Whenever, I do not like how my websites rank in the search engines, I sprinkle my magic fairy dust on my modem.

If you don't like where you are ranked in the search engines, then I suggest you forego the search engine optimization companies altogether and instead run over to the corner store to get your own magic fairy dust. You might have to shop around a bit, but it is out there.

The Dukes Of Hazzard (Season 2) DVD Review

In the late 70's and early 80's, television viewers fell in love with The Dukes of Hazzard, a weekly foray into the fictional setting of Hazzard County, Georgia. Cousins Bo and Luke Duke (John Schneider and Tom Wopat) spent each episode trying to do good, while the loveable Boss Hogg (Sorrell Booke) concocted various schemes for making money and having the Duke boys, who always foiled his plans, thrown in jail for violating their probation (the result of a deal with the federal government to end the centuries-old Duke family tradition of bootlegging).

Joining Bo and Luke are their Uncle Jesse (Denver Pyle), a grandfatherly figure who owns the family farm, and Cousin Daisy (Catherine Bach), whose skimpy shorts coined the cultural term daisy dukes. Along with Crazy Cooter (Ben Jones), the local mechanic, they create a formidable threat to the money-making shenanigans of Sheriff Rosco P. Coltrane (James Best) and the owner of seemingly every business entity in Hazzard County, J.D. Boss Hogg. It's a pretty regular occurrence for someone to contact me asking a way to earn $10,000 or more over a weekend. And in almost every case where I get these emails, they also tell me their sad story of how they will lose everything if they don't earn that much by Monday.

These emails can be hard on your emotions. You want to help them, but you also know the truth.

The truth is that Internet marketing is a business, not an overnight riches scheme. Is it possible to earn a lot of money quickly online? Of course it is. I've done it many times and my students have done it as well.

Here's a quick formula for success:

1. Find a Hot Product Selling to a Hungry Market.

This is essential. If you don't have a product that people are wanting and literally demanding to buy from someone, you'll have trouble making sales.

You can create the product yourself or you can license it from someone else. Creating a good high quality product will most likely take you longer than a weekend. I have personally written an entire ebook in a weekend, but that was HARD work and meant I did nothing else that weekend.

Licensing the product of course would be quicker, but the key here is to make sure you license something that is still a hot seller. It needs to have good sales materials and be targeted to a group of customers who are HUNGRY for the type of product you're going to sell.

Whether you create it yourself or license it, you have to control the product.

2. Develop Powerful Sales Materials.

You can have the best product in the world and it will die of underexposure. Your sales copy and ads have to be powerful and hit your customer's hot emotional buttons.

I learned this years ago, but it seems most online marketers are still having trouble with it. Your ad has to be written first to your customers emotions...and then to their logic. They don't buy based on logic. They buy based on emotions. Then they justify their decision with logic.

So they buy your product for the "feelings" they get owning it and the fact it pushes them closer to whatever their dreams are. They justify their decision to friends and family based on the logic of how great your product is.

Ask anyone why they bought that Mercedes and see what logical reasons they give you (but you know the real reason is because of how it makes them feel).

If you license a product, it should already come with a powerful sales piece. If you create your own, you'll either have to write a sales letter or pay $5,000+ to have a good copywriter do one for you.

3. Find Joint Venture Partners to Promote It.

This is the key to making money quickly. If you want to earn a good income in a short period of time, you HAVE to do joint ventures. There is no other good way of doing it.

A joint venture is simply finding someone who already has your target customers in their email list or on their customer list. Then you convince them to endorse your product to their list for a share of the profits.

This is why having control of the product you're selling is SO important. If you don't control it, how can you offer someone else 50% to 80% or more of the profits on it. If you're just an affiliate for other people's products, you're limited in your ability to find partners.

Big joint venture partners aren't going to work for 10%, 20%, or even 30% of the money. They want good deals and big profits if they're going to endorse you to their list.

So you have to offer it to them. Here are your options for big money...

Give more than 50% of your profits to someone who has a list of 100,000 targeted subscribers, or take years to build that list and relationship with them (the relationship with the subscribers is what takes time as a list can be built very quickly).

So that's the simple three step plan...

1. Find a Hot Product to a Hungry Market.
2. Develop Powerful Sales Materials.
3. Find Joint Venture Partners to Promote It.

Can the above be done quickly? The answer is yes. I've seen customers do it in 30 days or less. I have NOT seen it done from scratch by a beginner in a weekend.

And I've seen the majority of customers take much longer than 30 days to complete the above steps. So don't get down on yourself if it takes you 6 months or a year to start earning money online.

Ask that McDonald's owner how long it took them to get into profit. They didn't do it the first month, the first year, or even the first few years. It takes them a lot of time, money, and energy to get it producing consistent income above their investment.

Aren't you glad the Internet doesn't have all that overhead? We can do it so much quicker and with less stress. So don't stress yourself out by trying to Get Rich Quick.

If you're looking for a no risk income that you have to earn by a certain date, then get a job. Your employer will be required to pay you on payday.

If you want a business with unlimited income, then realize it is a business. It takes time. It takes risk. And it takes a serious commitment to run a business.
